O APPENDIX A NOTICE OF VIOLATION U. S. Department of Commerce National Bureau of Standards Washington, D. C.
Docket No.70-398 Based on the results of an NRC inspection conducted on September 29-October 1.
1980, it appears that one of your activities was not conducted in full com-pliance with NRC regulations and the conditions of your NRC License No. SNM-362 as indicated below.
10 CFR 71.5 prohibits delivery of licensed material to a carrier for transport unless the licensee complies with applicable regulations of the Department of Transportation in 49 CFR Parts 170-189.
49 CFR 173.391(a) states, in part, that " limited quantities of radioactive materials in normal form not exceeding.. 0.1 millicuries of Group II radio-nuclides...are excepted from specification packaging, marking, and labeling if...".
49 CFR 172.403(a) states, "Unless excepted from labeling by 173.391 or 173.392 of this subchapter, each package of radioactive material must be labeled as provided in this section."
Contrary to the above, on August 25, 1980, the licensee delivered a package to a carrier for transport, the package contained radioactive material (U-233) which was in excess of 0.1 mil 11 curies of Group II radionuclides (0.95 millicuries U-233), and the package was not labeled to identify the contents.
This is a Severity Level IV noncompliance.
