SUMARY OF MEETING ON JANUARY 29, 1981 TO DISCUSS THE SCHEDULE FOR SUBMITTING THE OL APPLICATION Summary A meeting was held at NRC Headquarters, 7920 Norfolk Avenue, Bethesda, Maryland on Thursday, January 29, 1981. The purpose of the meeting was to discuss the applicant's plans and schedule for submitting its application for operating licenses for the Vogtle Nuclear Plant. An overview of the applicants schedule is given by the bar chart shown in Enclosure 1.

A list of attendees is given in Enclosure 2.

The need for an expeditious review of the fish impingement study of the intake structure required by paragraph 3.E.7 of the construction permits was also discussed.

Meeting Details The part of the meeting devoted to discussing the applicant's plans and schedule for submitting the application for operating licenses for the Vogtle Nuclear Plant consisted of a series of discussions with individual NRC staff members on e]ch topic.

The meeting opened with a brief discussion of the bar chart (Enclosure 1) furnished by the applicant. The applicant intends to submit the application about March 1982, and is projecting a Unit I fuel loading date 32 months later, or November 1984. The applicant commented that March 1982 submittal is not subject to significant improvement.

S. Burwell coninented that based on an estimated construction completion of 20 percent at this time and the curve developed by the Caseload Forecast Panel, we would project a June 1985 fuel loading for Unit 1.

If this becomes the case, there are 39 months available for the review and hearing after submittal of the FSAR. Our recent experience with this leads to a conclusion that 24 months for the safety review and 15 months for a contested hearing and its asso-ciated delays (a total of 39 months) is a reasonable guess at the time required to obtain an operating license.

The applicant noted that it does not intend to submit the Environmental Report until November 1982, or eight months after the submittal of the FSAR.

S. Burwell comented that our schedule for ongoing environmental reviews shows about 14 months from the start of the review to issuance of the Final Environmental Statement. The form and content of the Environ-mental Report was discussed.

W. Regan (NRC) noted the proposed revision to 10 CFR Part 51, and comented that he does not expect there will be a significant impact on Regulatory Guide 4.2 for operating license applications.

The staff views the Environmental Report for the operating license as a forward looking document, i.e., it looks at the impact of operating the plant. We discussed how to handle those portions of the Environmental Report related to operations which have not changed from the Environmental Report filed for the construction permit.

W. Regan advised that the NRC is working on a Environmental Standard Review Plan for operating licenses which he predicts will be issued later this year.

We discussed the submittal date for the antitrust portion of the operating license and the staff does not foresee any difficulty with the applicant's schesle.

A. Toalston provided a copy of Regulatory Guide 9.3 and discussed the information needed for the NRC's antitrust review of operating license applications.

We discussed the r'equirements for including a discussion of the environmental impact of accidents which exceed the severity of design basis accidents.

The forthcoming Environmental Report is required to include a description of the resultant impact in conformance with the Commission's Policy Statement dated June 13, 1980.

R. W. Houston advised that the applicant should keep abreast of DES and FES issuances by the NRC as guidance in preparing their Environmental Report.

A second part of the meeting was devoted to discussing the need for an expeditious review of the fish impingement study of the intake structure required by paragraph 3.E.7 of the construction permits. The applicant advised that the Corps of Engineers will be approving their permit for construction of this intake structure much earlier than anticipated. The applicant would like to start construction by March 1,1981, and requested that we review and approve the report provided in response to this requirement. The report was transmitted by a letter from Georgia Power Company dated January 28, 1981 (NRC Accession Number 8101300398). We discussed the jurisdiction of these matters under the Clean Waters Act, advising we will need documentation on the 401 certification.
