BMCh 65 Comes now the State of Alabama through its Health Officer and moves that the State be given ' adequate time to respond to the contentions of ~
the Safe Energy Alliance of Central Alabama (SEACA).
I.
Facts 1.
By order dated February 2,1981, this Board specified that SEACA staff and Westinghouse were to file stipulated contentions within "the next ini: r u n.~ ~,

As of February 18, 1981, the stipulated and contested cBn'tentions have not been filed according to counsel for staf f and 57.XCA'.

II.
Argument 1.
Since fully 16 days have passed and the SEACA contentions have not been filed, the intent of the Board order of February 2,1981, has not been met.
2.
As a general policy, 10 CFR 2 appears to provide parties ten (10) days to respond to filing as is anticipated from SEACA, see 10 CFR 2.706 and 10 CFR 2.730(c).
3.
Even if the SEACA contentions were received on February 19, 1981, insdequate time exists for the State of Alabama to respond by February 20, 1981, as specified in the Board's order of February 2, 1981.
Conclusion For all the above reasons, the State of Alabama respectfully requests 4
this Board grant its motion to have adequate time to respond to any SEACA concentions when and if they are filed.
