This is in response to your letter of September 8,1980 which was in response to the Notice of Violation and Notice of Proposed Imposition of Civil Penalties sent to you with our letter of August 7, 1980.
The letter and Notice of Violation concerned items of apparent noncompliance associated with shipment of radioactive liquid samples from your facility in Middletown, Pennsylvania on February 6,1980 to Babcock and Wilcox, Lynchburg, Virginia and March 6, 1980, to Oak Ridge National Laboratory, Oak Ridge, Tennessee, and shipment of radioactive waste from your facility to the Nuclear Engi-neering Company, Richland, Washington disposal site, on June 6,1980.
We acknowledge receipt of your check in the amount of $5,000 in payment of the proposed civil penalties for Items A and C set forth in the Notice of Violation.
In your response you dispute the noncompliance item B of the Notice of Violation.
After careful consideration of your response, we have concluded that your shipment of the reactor coolant sample on February 6, 1980 was packaged in accordance with regulatory requirements.
Accordingly, the civil penalty for item B is mitigated by $2,000.00.
However, your shipment of 10 liquid samples in polyethylene bottles as the inner containers on March 6, 1980 was not packaged in accordance with 49 CFR requirements as indicated in the Notice of Violation sent to ycu on August 7, 1980.
Accordingly, we hereby serve the enclosed order on Metropolitan Edison Company impcsing a civil penalty in the amount of two thousand dollars ($2,000.00).
We plan to continue to conduct unannounced inspections of your licensed activities. The results of these inspections including your implementation of the corrective actions addressed in your letter of September 8,1980 will be considered in determining whether further enforcement action, such as modification, suspension or revocation of your license is appropriate.
