Gentlemen:

This refers to your letter of November 10, 1980 requesting an amendment to your Quality Assurance (QA) program for transportation activities.

As an owner, user of radioactive material shipping packages, all the applicable criteria of your 10 CFR 50 Appendix B QA program should be applied to your transportation activities. This would include design, fabrication, assembly, testing, procurement, maintenance, repair, modifications, and use to the extent these activities are conducted by Carolina Power and Light Company. We see no basis to exclude these activities from your QA~ program where transportation activities are conducted by others for packages not owned by Carolina Power and Light Company. A certification that applicable activities were conducted under an approved QA program plan is acceptable to the NRC. The QA program

should not be package dependent and require a revision as new packages are used by Carolina Power and Light Company.

As provided by 10 CFR 71.51(b), a Consnission approved QA program which satisfies the applicable criteria of Appendix B of Part 50 is acceptable for application to transportation activities.

Consequently, Camlina Power and Light Company should provide a connitment to NRC that the quality assurance program approval for Appendix B of Part 50 will be maintained and executed with regard to applicable criteria for transport packages.
