Dear Mr. Fiorelli:

This is in response to your Notice of Violation and Inspection Report Number 50-461/80-23. The item of noncompliance cited in the report states, in part:

" Contrary to the above, installation of the inclined fuel transfer tube was performed using the containment polar crane beam as a load-carrying support. Architect Engineer written approval or engineering calculations / rationale were not obtained prior to the rigging and load application."

A nonconformance report was issued to document this procedural non-compliance. After obtaining concurrence from the manufacturer of the polar crane, the Architect Engineer provided their written approval for use of the polar crane beam as a deadman or hold back support as used during installation of the inclined fuel transfer tube.

Formal corrective action was taken to avoid future noncompliances of this nature. Action taken included training of appropriate contractor and Illinois Power Company personnel regarding the restrictions of the Baldwin Associates' Rigging, Hoisting, and Handling Procedure, BAP 2.11.

These actions have now been completed and the work is now considered to be in full compliance with established requirements.

I trust that the above actions constitute an acceptable response and will satisfactorily complete our corrective action.
