Coleman took exception to the Atomic Safety & Licensing Board's (ASL3) Initial Decision of October ?' 1980.as .

granted by 10 CFR 2 710, 2 786 and 2 762 on November 11, 1980 and herein request an extension of time to submit our 3rief in Support of Exceptions until January 31, 1981 for the following reasons:

The State of New Jersey Department of Public Advocate, Division of Public Interest Advocacy has withdrawn (officially) as our counsel, per notice to the Atomic Safety &

Licensing Appeal Board (our copy is undated and without service list). We would appreciate you supplying us with a7a%~~ nS

to review the transcripts which have accumulated over the past three (3) years

and substantive evidence which has come to our attention recently in the Salem .

3 Prior commitments at place.:cf employ-ment make it extremely difficult to meet the regulatory deadline.

While it is neither our intent to burden the record nor delay this proceeding, we see no reason not to grant our request for extension in light of the Nuclear Regulatory Commission's recommendation not to consider an appeal of this decision (Howard K.

Shapar, Executive Legal Director, Office of the Executive Legal Director to Harold R. Denton, November 3, 1980). This hasty recommendation was made seven (7) days after the ASLB Initial Decision. We fail to understand the logic.of Mr. Shapar's recommendation to the Commission not to accept an appeal unless a similar letter (unknown to the intervenors) from the Appeal Board has already been drafted, accepting the Initial Decision of the ASL3 and denying the intervenors appeal.
