MOTION FOR EXTENSION OF TIME TO 4
FILE MOTION FOR
SUMMARY
DISPOSITION l
i 4
j The NRC Staff moves the Atomic Safety & Licensing Board to grant a two-day extension of time, until November 14, 1980, in which to file motions for J
j summary disposition. The NRC Staff has spoken with a representative of the
)
Consolidated Intervenors and counsel for the licensee. Neither of them has
{
any objection to the requested extension of time.
As established by the Licensing Board, the' expedited schedule for this proceeding provides only 17 calendar days between the time for filing responses to interrogatories and the time for filing motions for summary disposition.
l Under the procedures being followed in this proceeding, no formal contentions
[
.have been filed by the intervenors. Thus the first statement of Consolidated i
j.
Intervenors' position available to the Staff has been in responses to interro-gatories. The Staff did not receive Consolidated Intervenors' responses until I
late in the day on November 3,180.
The Staff notes that service of the j
interrogatories was made on October 28 rather than on October 27 as provided I
for.in the Board's Order of October 20, 1980.
Because of previously estab-
{
lished commitments, Staff technical personnel were unavailable for consultation for several days following receipt of the responses.
Consequently, the Staff requests a two-day extension of time for filing its motion for summary o

_2-disposition so that it can adequately prepare its motion. To the extent that expeditious resolution of the issues before the Board is of concern, this twc-day extension is appropriate since summary disposition may reduce the need for a hearing on some issues in this proceeding.
For good cause shown, the Staff requests that its motion for an extcasion of time be granted.
Respectfully submitted, jfh4 Stephen G(zw e d$f%s Burns Counsel to NRC Staff n
