In Re : Florida Power Corporation Crystal River Plant, Units 3 & b Dockets $50-302 and 50-303 Dear Dr. Morris.
The Florida Power Corporation application for a construction permit was filed on August 10, 1967 and specified a co=nercial operating date of April,1972 for Unit #3 Certain site preparatory work for Unit 3 such as exesvation, backfill and sub-surface grouting win be coc:menced immediately. This work is clearly authorized by 10 CFR 50.10 (b) (1).

access and inspection Gallery (see pSAR Vol. 2, Figure 5-1) must be completed before reinforcin6 steel for the base slab may be placed. The gallery is phy-

sically below the base slab and is not a structural part of the containment structure. The containment structure does not' depend upon the access gallery' for support.
The access 6ellery has reinforced concrete walls and floors about 24 inches nominal thickness and is desi6ned to conventional reinforced concrete specifi-i cations. It is approximately six feet wide, eight feet high, and four hundred and thirty feet in circumference. The gallery may be compared generally to a conventional reinforced concrete draina6e culvert of the same dimensions cost-ing some $50,000.
The gallery is a service facility that can be demolished, altered or removed if necessary. It is an entirely different structure and situation than is in-volved in the ' pouring the foundations for, or the installation of, any portion

of the pemanent facility". The. function of the gallery does not require it to be desi6ned to the same codes and criteria as the nine foot thick base slab and the containment walls since the gallery is not a part of the engineered safe-guards or contaiment of the power reactor facility. Rather, it will be designed t'd built according to standard practice, as will the conventional portions of i = power plant. Based on the accessory function to be served by the gallery, we are of the opinion that this item of the Crystal River project can properly be construed as " preparation of the site for construction of the facility" as provided for in 10 CFR 5910(b)(1).

held in the Matter of Boston Edison Company (Docket 50-293) on November 16, 1967 Specifically this would include the pouring of a concrete leveling mat below the base slab of the reactor building, erection of forms and the loose
', placement of reinforcement steel for the base slab of the reactor building.
Should, howcVer, the Co= mission conclude that the gallery does not come uithin the provisions of 10 CFR 50.10(b)l), an exe=ption under 10 CFR 50.12 is justi-fled. The granting of such an exemption will not endanger life or property or the co=u m defense and security. Florida Power Corporation further believes that cn 3xemption would be in the public interest.. Construction of the gallery ic a minar phace of the overall project. However, its scheduling is critical and must occur at an early stage. Otherwise the placing of the' steel for the base clab cannot be undertaken and the start of construction of the facility will be delayed some ten weeks after the issuance of a construction pe=it.
Accordingly, the applicant respectfully requests an opinion by the Co=icsion that completion of the accece gallery for Unit 3 as set forth in this letter, properly falls within the provisions of 10 CFR 50.10(b) (1). Alternatively, the applicant respectfully request: e specific exemption by the Co=icsion as provided in 10 CFR 50.12. On August 25, 1967, In the Matter of Duke power Company (Dockets Nos. 50-269, 50-270, and 50-287) the Co= mission authorized construction of a tendon access gallery under analogous circu= stances.
Florida Power Corporation understands, of course, that action by the Commis Lon on the request t:ontained in this letter will have no effect on the subsequent

granting or denial of permits for the proposed Cryctal River duelear project.
