Dear Mr. Rusche:
My letter of September 12, 1975, requested an amendment of the Oconee Nuclear Station Unit 3 Facility Operating License.
The proposed amendment relates to a modification of the Unit 3 Fuel Storage Facility and a related Technical Specifications change.
The proposed modification involves replacing the existing fuel ~ storage rack with the Combustion Engineering, incorporated, supplied High Capacity Fuel Assembly Storage Rack and consists of three phases:
removal of the existing rack, installation of the new rack, and utilization of the new rack. We have performed an evaluation to determine if the propcsed ;nodification involves an unreviewed safety question. The processes of cemoval of the existing rack (spent fuel has not been stored in Unit 3 spent fuel pool) and the installation of the new rack are determined not to involve any unreviewed safety questions.
However, utilization of the new rack may constitute an unreviewed safety question in that the proposed modification involves a change in the effective multiplication factor (k-effective) of the fuel to be stored from the present value of less than 0 9 to a value of less than 0 95 (meeting the requirement of Criterion 5.7 4.1 in ANSI N18.2-1973). Therefore, if the Comission deems it necessary to declare the proposed license amendment to involve an unreviewed safety question in order to act' on Duke's request, it may be treated as such.
As indicated in my September. 12, 1975 letter, this modification is to be effected prior to the Unit 3 refueling, which is scheduled for September, 1976.
