+0p MEMORANDUM T0 COUNSEL FOR THE PARTIES 67 The purpose of this memorandum is to disclose to the parties to this pro-ceeding my previous involvement with the pending conversion of the Oyster Crtek provisional operating license to a full-term operating license as a member of the Advisory Comittee on Reactor Safeguards (ACRS) from August 1,1966, to May 12,1972, and while I was Deputy Director for Technical Review, Directorate of Licensing of the Atomic Energy Commission, a position I held tr e May 15, 1972, to July 23, 1974. While I was on the ACRS, there was no considera-tion of the issues now pending before the Commission. Moreover, a review of my files reveals that I had no direct or substantial involvement with this matter.

I do not have a personal file for this facility and conclude that I did not receive any documents concerning that facility while I was Deputy Director for Technical Review.

I have not formed any conclusions as to the merits of the pending proceed-ing, and, in my judgment, my ability to consider impartially the issues in the current proceeding is unimpaired.

In these circumstances, my preliminary inten-tion is to participate in any Commission consideration of this Appeal Board decision. However, I will consider any objections to my participation received before November 12, 1980 and will give careful consideration to any objec'tfon before finally determining whether I ould participate.
