Dear Mr. Burstein:

In a letter dated August 2,1979, we issued our Fire Protection Safety Evaluation Report (SER) for Point Beach Nuclear Plant, Unit Nos.1 and i

2.

Section 3.1 of this report identified sixteen items (marked with an asterisk) for which we required additional information to assure an acceptable design prior to actual implementation of the modifications.

Based on our review of your letters dated September 26, 1979, December 20, 1979, and June 23, 1980, six of these items are now resolved, as discussed in the enclosed SER Supplement.

t In addition, the original SER identified six items for which our review had not been co pleted.

Based on our review of your letter of December 20, 1979 ard the usuance of Amendment Nos. 41 and 46 on November 13, 1979, two of these i..;~:plete items are now resolved. Their resolution is also ciscussed in the enclosed SER Supplement.

On May 29,1980, the Comission published a proposed rule, a new paragraph 50.48 and Appendix R to 10 CFR Part 50, concerning fire protection, which sets forth the minimum acceptable fire protection requirements necessary to resolve contested areas of concern for nuclear power plants operating prior to January 1,1979.

We have reviewed all the information you have provided to date regarding ycur fire protection program. At this point, ten items in Section 3.1 and four items in Section 3.2 of our SER dated August 2,1979 remain 4

unresolved. The enclosed " Summary of Staff Requirer..ents to Resolve Open Items" presents our position on modifications that would have to be made at your facility to resolve these open items in a manner that would meet the requirements of the preposed Appendix R.
