II.

On November '4,1.977, the Union of Concerned Scientists (UCS) filed with the Comission a " Petition for Emergency and Remedial Relief." The petition sought ~ action in two areas:

fire-protectionifor electrical-cables, and environmental qualification of electrical. components. -By Memorandum and Order ~ dated April 13,1978 l(7 NRC_400), the Comission

ordered the NRC staff to-take several related actions.

UCS. filed a Petition for Reconsideration on May 2, -1978. By Memorandum and-Order, dated May-23,il980, the Comission. reaffirmed its April 13,1978 decision I

The Comission 1-Bulletin:79-01B was not sent to licensees for. plants under review as part of the staff's Systematic Evaluation Program.

These. m accidents are Loss ofloolant: Accident and Main Steam Line Break' inside containment, Jand High Energy LinefBreaks inside and outside containment. In this connection the licensee was requested by I&E.Bulletin 79-018 of Januaryf14,.1980 to provide a deta'iled review of the environmental ' qualification ~ of Class lE electrical equipment. This review was to include - all equipment required to function under postulated accident' conditions, both inside and outside the primary containment, and recognize' all condi- ~ tions specified in the bulletin. Evidence of qualification together with methods and justification. -was requested. Clarification was provided by supplemental information,- briefings, and in some cases, meetings with the licensee. Timely completion of the staff's review of environmental qualification of electrical equipment and timely completion of needed modifications by ~the licensee is required to provide continuing reasonable assurance of public health and ' safety. Such conpletion is dependent on the pronpt receipt of a conplete response by the licentae to the staff's requests for. information. However, the licensee's response, to date, is incomplete. Therefore,11 have concluded that the public health, safety,. and interest require.that a firm schedule for the timely submission of all the information'previously requested.by the staff should be established - by Order effebtive immediately. t g. ~ a -m s p y,, y n 9.- rt e-r ^ ~ u .. h,,, i.. 9 ~ -5. Accordingly, pursuant'.t'o the Atomic' Energy Act _of 195'4,. as. amended, and-- the Comission'sfregulations-in 10lCFR Parts 2.and 50,i!T IS ORDERED ' THAT EFFECTIVE IMMEDIATELY-Facility Operating License No. iNPF-2 is hereby amended to: add the following provisions: "Information which' fully and completely responds to the staff's request as specified above, shall be ' submitted to the Director, Division of Licensing-by the licensee not later than November _ l, 1980." An earlier response is encouraged to-facilitate staff review and issuance of the-safety. evaluation report. The licensee or any person whose interest may.be-affected by this Order may request a hearing within 20 days of the date of this_ Order. Any request for a hearing will not_ stay the effactive date of this Order. Any request for a hearing shall be addressed to the Director,:0ffice of. Nuclear Reactor Regulation, U.S. Nuclear Regulatory Commission, Washington, D. C. 20555. A copy of the request should also be sent-to the Executive Legal Director, U. S. - Nuclear Regulatory Comission, Washi of.in, D. C. 20555, and to-George F. Trowbridge,. Esquire, Shaw, Pittman, Potts-and Trowbridge, -1800 M- ' Street, N.W.,= Washington, D. C. 20036, attorney for the licensee.
