Dear Mr. Abel :

By letter dated May 22, 1980 you requested our approval to count certain diesel generator starts done during safeguards tests and load sequence tests. You stated that the counting of these tests would not be in strict accord with Regulatory Guide (R.G.) 1.108 guidelines. This was because only those starts prior to March 30, 1980 did not fulfill the i one hour loading period of the Regulatory Guide. As of March 30,1980 all diesel generator tests have been in accordance with R.G.1.108. Our 3 Confirmatory Order of February 29,1980, Item B.6 relates to the diesel j generator testing per the R.G. E We have completed our review of your May 22, 1980 request. Based on our 3 review of the information provided, we conclude it is acceptable to count diesel generator starts for the safeguard actuation tests prior to May 19, 1980 as valid successful tests as specified in R.G.1.108. i Another matter relating to the diesel generator " Allowed Outage Time," for which you had requested a changelby letter dated June 3,1980 but ? had withdrawn by letter dated August li,1980, has been reviewed. The " Allowed Outage Time" is also a part of Item B.6 of our Confirmatory Order dated February 29, 1980. Our combined review of Item B.6 was completed prior to receipt of your August 11, 1980 withdrawal letter. We found no ? acceptable basis or justification for changing the allowable outage time requirements of the Confirmatory Order. Since our review was completed prior to receipt of your request for withdrawal, the fee has been charged. Additionally, your request of May 22, 1980 did not submit any fee. We consider the review of your May 22 and June 3,1980 requests for consideration for Item B.6 of 3 our Confirmatory Order of February 29, 1980 to be a single safety issue not involving a significant hazards consideration. ? 5 s 1 h e 80093006qq
