c Enclosed is an Executive Branch analysis covering a license application for the export of low-enriched uranium fuel to Indonesia for use in the Kartini Research Reactor.

55-242, the analysis explicitly

/ur<;be addresses how the requirements of Section 126 a. (1) of the 3

Atomic Energy Act are met, including the specific criteria of Sections 127 and 128, as well as certain additional h,

factors, envisaged by Section 126a. (1).

As the NRC is awars, the existing U.S.-Indonesia Agree-ment for Cooperation expires on September 21, 19G0.

The new U.S.-Indonesia Agreement for Cooperation was signed June 30 and is before Congress where it must lie for 60 days of continuous session before it may be brought into force.

If j

Congress adjourns on October 4, as planned, or earlier, we will be a few days short of ccmpleting this review period.

Depending on Congressional scheduling, we anticipate a gap between the existing and new agreements of from 3 weeks to six months.

As the proposed export of fuel for the Kartini Research Reactor is being made pursuant to the bilateral agreement, the license must be issued prior to the expiration of the existing agreement or await entry into force of the new agreement.

In view of the recent adherence to the NPT by Indonesia and the conclusion of its saf eguards agreement pursuant to the NPT on July 14, 1980, it is the judgment of the Executive Branch that the U.S. Government should make every effort to facilitate early approval of the Indonesia request for research reactor fuel.

NRC Export License; Special Nuclear Materials to Indonesia.

Dear Mr. Peterson:

General Atomic Company (GAC) is engaged in the manufacture and sale of nuc-lear reactors, nuclear instrumentation systems, components therefor, and co-operative resecrch in the development and testing of the components and fuels for research reactors.

In the normal servicing of our research reactors we are required to provide replacement equipment and materials.

In this instance General Atomic is supplying 20 TRIGA fuel elements and 4 fission cha=bers for use in partial refueling the TRIGA Hark II Reactor at the Bandung Reactor Center, Bandung, Indonesia, and the KARTINI Research Reactor at the Ga=a Atonic Research Centre, Yogyakarta, Indonesia.

GAC makes application, pursuant to 10 CFR 110, for license to export 501 in these fuel elements and fission chambers to the Badan Tenaga Aton Nasicnal at these two locations for aforepentioned reactors.

Enclosed is a Form NRC-7 giving specific details supporting the license request for this export.

These fuel elecents and fission chambers are manufactured and available for i==ediate shipment. They are urgently needed to allow normal operation of these reactors.

We request that you issue an export license at your earliest convenience with an expiration date of June 15, 1982 or two years after issuance of license.
