Inspection on Aoril 21, 1980 (Report No. 15000027/80-54)
As part of the inspection conducted April 21, 1980 through May 2, 1980, the
inspection of trailer 228146 is detailed in this report.
No containers were
opened.
No representative of the state of Nevada was present.
Results:
One apparent item of noncompliance with either DOT or NRC regulations was
observed.
See paragraphs 4 and 5.
It appears that the Department of Transportation and the Region IV office are
th:Te appropriate organizations to take enforcement actions.

1.
The shipment consisted of fourteen 55-gallon drums contained in a
shielded cask.
The vehicle was exclusive use and was properly
placarded.
2.
The drums were' identified as Radioactive-LSA.
3.
Surveys showed a maximum radiation level of 50 mr/hr at the surface
of the cask and 2 mr/hr at six feet from the vehicle.
Radiation
levels in the cab were essentially background.
4.
Two of the drums had radiation levels in excess of 1000 mr/hr as
provided for in Section 173.393(j)(2) of Part 173 of Department of
Transportation regulations. As shown on Nuclear Engineering Company
Radioactive Waite Shipment & Disposal Formt No. 6493 and 6494
(Appendix B and Appendix C), the drums identified as Items Nos. 80-4-1
and 80-4-2 showed radiation levels of 3,000 mr/hr and 1,500 mr/hr,
respectively.

NPPD, Cooper Nuclear Station, had orally informed Jim Crinkshank, NEC0 RSO,
' that the shielded container was the " package" rather than the individual
drums being the " packages."
If this contention of NPPD is correct,_the
" package" contained a Type B quantity of radioactive material, approximately
,.
10.4 curies of Group III and approximately 3.7 curies of Group IV.
Section 71.3 of Part 71 of NRC regulations states that, "No licensee
subject to the regulations in this part shall (a) deliver any licensed
materials to a carrier for transport or (b) transport licensed material
'
except as authorized in a general license or specific license issued by
the Commission, or as exempted in this part." The cask containing the
drums was not an NRC approved package. Therefore, NPPD, Cooper Nuclear
Station, was in apparent violation of Section 71.3 in that it was not
licensed to deliver the " package" to a carrier for transport.
