By application dated February 4, 1980, which your Company filed with the Office of Nuclear Reactor Regulation (0NRR), yott _ proposed Technical Specification changes relating to ANO-1 Diverse Reactor Building Isolation.

You did not submit a fee pursuant to 10 CFR 170.22 because you determined that the application involved a pro forma amendment which is a result of written Commission requests in September and October 1979, that it has minor safety significance and the amendment would be issued for the convenience of the U. S. Nuclear Regulatory Commission (USNRC).

When applications for license amendments or other approvals are requested by the USNRC for the purpose of enhancing the safe operation of a nuclear facility or to correct a problem or potential problem relating to operation (such as system reliability and performance and/or procedures), they are not exempt from the fee requirements of 170.22 unless specifically ordered by the USNRC pursuant to 10 CFR 2.204.

On this basis, licensees are required to pay fees for applications such as your February 4 application.

Based on information provided by the ONRR staff as a result of a preliminary review of your proposed changes, it has been determined that the proposed

action involves consideration of a single safety issue. As such, it requires a Class III fee of $4,000.

It is requested that your Company remit this amount to this office promptly.

If the final review of your application by the ONRR staff reveals that this fee is incorrect, an adjustment will be made.
