Dear Licensing Board Members:

This refers to the November 16, 1989 " Clarification of Contentions and Answer to Licensee's Response in Opposition to NEAP /Saporito Petition for Leave to Intervene" submitted in this

. proceeding by Thomas J. Saporito, Jr., Executive Director, Nuclear Energy Accountability Project.

10 CFR $ 2.714 provides for the filing of petitinns for leave to intervene and answers to such petitions.

The section does not provide for further pleadings.

Consequently, unless requested to do so by the Board, we will not enlarge the chain of unauthorized pleadings by submitting a response to the November 16, 1989 document.

However, that document repeats allegations which Florida Power & Light Company categorically rejected in our November 2, 1989 letter to the Board and makes further l-allegations and innuendoes of wrongdoing, illegality and i~

violations which are also unjustified and which FPL also rejects.
