SUPPORTING THE ORDER TERMINATING FACILITY OPERATING LICENSE NO. R-124 UNIVERSITY OF CALIFORNIA AT SANTA BARBARA L-77 RESEARCH REACTOR DOCKET NO. 50-433

1.0 INTRODUCTION

By letter dated September 9, 1985, as supplemented en November 20 and December 9, 1985, and March 24 and June 27 1986, the University of California at Santa Barbara (UCSB or the licensee), submitted a plan for dismantlement and decontamination of their L-77 Research Reactor Facility and a request for termination of Facility Operating License No. R-124 Following a review by the NRC staff, the plan was approved and the licensee commenced dismantlement and i

decontamination.

Upon completion of the dismantlement and decontamination, the licensee submitted a report, by letter dated January 5,1987, entitled " Final Survey Rtport for the UCSB L-77 Reactor Dismantling," as a basis for license termination.

On June 14 and 15,1989, Oak Ridge Associated Universities (0RAU)-

representatives preformed a termination survey at the facility under an interagency agreement and in accordance with a request for Technical Assistance from Region V.

The delay in processing this termination order resulted from the licensee's search to dispose of the lead reactor vessel and inner shield, which were activated and could not be shipped to an active burial site. This material is currently:

(a) adequately packaged for transportation to an, as of yet, unspecified disposal site; (b) stored in a closed cell in the Engineering Research Center; and (c) transferred to the State of California-radioactive materials license as Amendment No. 41 to California License No. 1336-42.

2.0' EVALUATION In a memorandum dated October 3,1989 (G. P. Yuhas, Region V, to T. S.

i Michaels, NRR) Region V concluded that, based on the termination survey performed by the ORAU, the residual contamination levels for the reactor facility comply with' the criteria of Regulatory Guide 1.86, Table I, which establishes acceptable residual surface contamination levels, and is below the exposure limit, established by the NRC staff, of 5 micro R/hr above background at one meter (see section 5.0 Reference). Therefore, the facility can be released for unrestricted use.

3.0 ENVIRONMENTAL CONSIDERATION

l The Commission has prepared an Environmental Assessment (EA), which was l

published in the FEDERAL REGISTER on! Novenber 16, 1989 (54FR47743. On the basis of the EA and the above Safety Evaluation, the Commission ha)s determined l

that no Environmental Impact Statement is required and that issuance of this Order terminating the license will have no significant adverse effect on the quality of the human environment.

4.0 CONCLUSION

Based on the foregoing considerations, the staff concludes that Facility Operatino License No R-124 can be terminated without undue risk to the health and safety of the public or workers, and without any significant impset on the public nr the environment, 5.0 REFERENCE MemorandumforF.J.Congel(NRC)toB.M.
