NRC STAFF MOTION TO EXTEND TIME TO RESPOND TO DAVID SPRINGER'S NOTICE OF APPEAL AND BRIEF David Springer filed a petition to intervene on April 15, 1980 which was denied by the Licensing Board on August 16, 1980.

From that denial, Mr.

Springer appeals.

The NRC Staff response to that appeal is due to be filed Wednesday, September 17, 1980.

The legal work required for other licensing actions and the shortness of the time psriod to reply to appeals on intervention petitions (10 days) prevents Staff counsel from treating Mr. Springer's appeal with the care and consideration it requires.

The Staff hereby moves the Appeal Board to extend until Tuesday, September 30, 1980 the time for the Staff to file its respense.

Staff counsel has today contacted Mr. Springer and Mr. McGarry, counsel for Duke Power Company, and Mr. Pfefferkorn, counsel for the Intervenors, and they have no objec-tion to the requested extension of time.
