l Gentlemen:

I During April and June 1979, your Company filed with the Office of Nuclear Reactor Regulation (0NRR) the following applications pertaining to the Arkansas Nuclear One - Unit No.1 facility and made the fee determinations pursuant to 10 CFR 170 specified below:

Application dated April 24, 1979, reTating to PORY setpoint change for which AP&L did not c:ake a fee determination nor i

remit a fee, but requested that it be considered as part of the Cycle 4 operation approval-en mdment, and 2.

Apolication dated June 6,1979, relating to anticipatory reactor itfip far which AP&L paid a Class III fee.

The-ONRR staff has provided data which conclude that:

(a) item 1 above involves a single safety issue and is considered to be a separate request from your Cycle 4 reload application; therefore, it requires a Class III fee of $4,000, and (b) item 2 above is exengt from fees because it results fmm the USNRC's Order dated May 17, 1979.

This letter is to advise you of these fee deteminatior.s and to let you know that we are applying the fees submitted with ites 2 to the application in l

item 1 rather than refunding $4,000 and concurrently b!111ng you for $4,000.

We deem this to be appropriate and less time consuming tbr all involved.

If this does not meet your Company's approval, it is requested that this office be notified.
