of the priority #4 documents, and for Intervenors, Staff and Applican ,

• a set of the documents themselves.

As stated at Tuesday's prehearing conference in Chicago, we did not expect to have these documents selected, reviewed and processed until "the end of the week." You indicated at a later point, however, that Dr. Timm would be in your office Friday and that you wanted him to look at all the Dow docu=ents, including these. Although I do not think these documents really relate to Dr. Timm's area of expertise, we do want these to be in your hands so that you can make that decision for yourself.

I do expect to send the index (priority #5) tomorrow, as promised. There undoubtedly has been some " slippage," and I am not yet ready to give assurances that we are now complete on all five categories. Our search is continuing, however, and we will promptly furnish any additional nacerials that are discovered. With that caveat, you have our representa-tion that by tomorrow you will have most of the documents in priority #1 through #5.

The Hearing Board suggested at the prehearing conference that procedures be developed for the handling of the document problem, with standard references identifying source (such as Applicant, Staff, Intervenors, Dow and the like), ways of identifying privilege, etc. We urge that the primary parties develop such a system, to which of course Dow will adhere so long as it continues to be a party. As the ddcu=ent problem proliferates, it undoubtedly would ease everyone's burden.

Early next week we will furnish a list further identifying the document and specific nature of the privilege claimed by Dow in its December 7 listing, as you requested Tuesday.
