MEMORANDUM AND ORDER November 26, 1973 THIS DOCUMENT CONTAINS P00R QUALITY PAGES (ALAS-160)

Saginaw Intervenors have filed what they choose to cha.racterize as a motion "to clarify" ALAB-123, RAI-73-5 331 (May 18, 1973).

The motion is based upon the November 6, 1973 memorandum and order of the Commission in Niagara Mohawk Power Corcoration, (Nine Mile Point, Unit No. 2), Docket No. 50-410, RAI-73-ll In that memorandum and order, the Commission reversed certain pre-hearing conference orders of a licensing board insofar as they precluded the presentation of evidence on energy conservation.

The proceeding was remanded to that board with appropriate directions.

Despite the label appended to it, the Saginaw Inter-venors' motion appears in actuality to assert a conflict so 73/

. between ALAB-123 and the Nine Mile Point 2 memorandum and order.

In a real sense, the relief which the Saginaw Intervenors seek is a remand of Midland to the Licensing Board "for further proceedings to consider questions of energy conservation" (Motion, p. 22).

ALAB-123 was rendered more than six months ago.

It affirmed, with a limited exception not here relevant, the initial decision of the Licensing Board.b!

In the cir-cumstances, we think it at best doubtful whether we now are empowered to entertain what is essentially a new attack by the Saginaw Intervenors upon the initial decision.

Be that as it may, since the motion is based exclusively upon a recent ruling of the Commission, it seems to us that the Commission itself is the body which should decide whether the sought reopening of the Midland proceeding is warranted.

This is especially so since, in its Nine Mile Point 2 memorandum and order, the Commission made snecific reference to ALAB-123 (as well as to our more recent decision in Long Island Lighting Co. (Shoreham Nuclear Power Station), ALAB-156, RAI-73-10 831 (October 26, 1973)).

1/ The only issues left open by ALAB-123 related to quality assurance matters.

Over six weeks ago, those matters received final disposition on our part.

ALAB-152, RAI-73-10 816 (October 5, 1973).
