Dear Mr. Cherry:

In your letter of January 5, 1977, you requested ~

"the relevant contracts with NFS (or'other persons or com-panies with whom you are presently involved) concerning nuclear fuel and or reprocessing". In that letter you stated that it was your understanding that Consumers had testified before the Michigan Public Service Commission that it had "no enforceable contract with Nuclear Fuel Services l or anyone else concerning fuel or reprocessing for the Midland plant". Consumers' position is that it does have an enforceable contract with Nuclear Fuel Services.  ;

In order to correct any misunderstanding you may have in this regard, I am enclosing for your use the fol- 1 lowing documents: l

1. Prepared testimony of Ronald L. Helk's dated January 6, 1977, before the Michigan Public Service Commission; f.
2. Exhibits of Ronald L. Heiks dated '

January 6, 1977, before the Michigan Public Service Commission;

3. Prepared testimony of Edway Richard Johnson dated January 6, 1977, before the Michigan Public Service Commission.

v. Nuclear Fuel Services, Inc. The contract between Nuclear

, Fuel Services, Inc. and Consumers Power Company is attached to the Complaint. As you will note, this contract is not applicable to Midland since it specifies that it only in-cludes fuel from Consumers nuclear reactors which will be operating by 1980. '

With regard to the second portion of your request, i.e., the relevant contracts with other persons or companies concerning " nuclear fuel", I assume that you are referring to fabrication contracts for nucl2ar fuel.

Consumers cur-rently has such a contract with Babcock & Wilcox Company.

However, this document is considered proprietary by Con-sumers Company and the Babcock & Wilcox Company. As a result, if you wish to obtain this contract I will request that the Board rule that it is proprietary and order you to treat.it,as such prior to my releasing that document to you.
