As you will see frois that letter, on the basis of an extensive evidentiary record its these licensing proceedings, the Atoinie Satety and Licensing Board found that the emergency plan for this f acility complied with the requirenents of Appendix E to 10 CFR 50 of the Cucriission's regulations which govern the for-ulation of evertency plans at the construction permit stage of licensing proceedings. This finding was confirmed on appeal by the Atomic Safety and Licensine Appeal Board.
Also enclosed is a bricf Jcceription of the praecss the ""O has been and will in the future follow in carrying out our regulatory responsibilities related to the licensing of the Midland facility.

_R_EG_U_LAT__O_RY__ R__EV_ _I_EW PR_O__C_E_S_S The Nuclear Regulatory Commission (NRC), in its review of applications
. for licenses to construct and operate nuclear power plants, is required by the Atomic Energy Act of 1954, as amended, to co.nsider those measures
. ncecssary for protection of the health and saf ety of the public.
Ta carry out this respohsibility, the Commission's statt conducts a detailed review of all nuclear plant applications to assure that they can be

built and operated at the proposed locations without undue risk to the health and safety of the public.

Interested. parties may submit written statements to the licensing board to be entered into the hearing record, they may appear to give dircet statements as limited participants in. the hearing, or they may petition for leave to interhene as full participants in the

hearines, thereby beine granted the right to cross-examine all direct-testimony in the proceeding.
At en early stage in the review process, potential iptervonors may meet informally and discuss with the staf f their concerns with respect to the facility.
