unless the licensee complies with the applicable requirements of the regulations appropriate to the mode of transport, of the Department of Transportation in 49 CFR Parts 170-189..."
49 CFR 1/3.393, " General packaging and shipment requirements" states "Unless otherwise specified, all shipments of radioactive mate 'ials must meet all requirements of this section..."
49 CFR.173.393(f)(3) limits the dose rate from licensed radioactive material to ten millirem per hour at any point 2 meters (six feet) from the vertical planes projected by the outer lateral surfaces of the car or vehicle consigned for exclusive use.
Contrary to the above, a shipment.cf licensed radioactive material was made by tha licensee to Barnwell, South Caroli'na on December 14, 1979, in an exclusive use vehicle,-in which the dose rate as measured from the licensed material was 15-17 millires per hour at 2 meters (six feet) from the vertical planes projected by the outer lateral surfaces of the vehicle, upon receipt of the material at Barnwell, South Carolina on December 17, 1979.
This-is a Violation.

.This Notice of Violation is sent to Boston Edison Company pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, code of Federal Regulations. ' Boston Edison company is hereby required to submit to this office within twenty (20) days of the receipt of this notice, a written statement or explanation in reply, including for each item of noncompliance:
(1) admission or denial of the alleged items of noncompliance; (2) the reasons for the items of noncompliance if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be

taken to avoid further items of noncompliance; and-(5) the date when full compliance will be achieved.
