July 30, 1980 0FFICE OF INSPECTION AND ENFORCEMENT EN-80-32 NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Carolina Power and Light Ccmpany, Raleigh, NC (Brunswick Units 1 and 2)

Subject:

PROPOSED IMPOSITION OF CIVIL PENALTIES - $89,000 This is to inform the Commission that a Notice of Violation and a Notice of Proposed Imposition of Civil Penalties in the amount of Eighty-Nine Thousand Dollars will be issued on or about August 1,1980, to Carol'na Power and Light Company.

This action is based on items of noncompliance relating to improper disposition of licensed radioactive material at a Brunswick County sanitary landfill near Southport, North Carolina, and the sale of items contaminated with radioactive material to salvage dealers in Wilmington and Goldsboro, North Carolina. A news release has been prepared and will be issued about the time the licensee receives the Notices. The State of North Carolina will be informed.

It should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Following NRC staff evaluation of the response, the civil panalties may be remitted, mitigated or imposed by Order.
