This refers to your letter dated May 27, 1980, in response to our letter dated May 7, 1980.
We acknowledge: 1) receipt of your check in the amount of Four Thcusarc Dollars in full payment of the civil penalty proposed in our letter rtferenced above; and 2) receipt of your letter informing us of the corrective actions taken.
In your reply you contend that there was an error in the " Notice of Violation" in that the " Notice of Violation" did not reflect that you intended to make the shipment as an exclusive use shipment under the provisions of 49 CFR 172.393(j).
As was explained in Inspection Report No. 50-271/80,-03, the radiation from the underside of the flatbed trailer was greater than the limit I
pertaining to exclusive use vehicles given in 49 CFR 173.393(j)(2).
- However, since the transport veh'cle was not a closed vehicle, packages reading greater than 200 millirem per hour could not be shipped under the provisions of 49 CFR 173.393(j)(1).
Instead, the packages had to meet the conditions of 49 CFR 173.393(i).
In your reply you stated that in the future, you will assure th'at shipments of packaged waste will be made in a manner satisfying 49 CFR 173.393(f).
This corrective action, if carried out, should prevent a recur-rence of noncompl brse with either 49 CFR 173.393(j)(2) or 49 CFR 173.393(i).
Based on the results of future inspections of your licensed activities, including the implementation of corrective actions as described in your letter, we will determine whether any further enforcement action, such as modification, suspension or revocation of your license is appropriate.

Procedure changes have already been implemented to preclude future occurrences.
Attach =ent 1 of this letter sets forth in detail our response to your " Notice of Violation". This attachment also describes an error in the " Notice of Violation".

Imposition of a Civil Penalty Dated Mav, 7, 1980 Contrary to the statement in the " Notice of Violation", the shipment was an exclusive use shipment =ade under the provisions of 49 CFR 173. 393. (j ). As previously stated, the trailer was incorrectly surveyed, thus allowing the trailer to proceed in violation of 49 CFR 173.393(j).
As described in References (b), (c), and (d), Shipment 80-02 was incorrectly surveyed prior to its release for shipment to Richland, Washington. This resulted in the failure to detect radiation levels at the external surface of the trailer that were in excess of the 200 millirem / hour limit stated in 49 CFR 173.393.j (2).
Previously, Vermont Yankee did not consider the underneath portion of the trailer or the top portion of the trailer to be accessible areas and as such did not survey those areas.
In accordance with the " Corrective Action" described in Reference (c), the Ver=ont Yankee Administrative procedure A? 0504 covering ship-1 ment of radioactive waste, has been revised to require surveys of all areas of a shipment.
In addition, this procedure was revised to clarify the instructions necessary to maintain exclusive use shipment controls.
This revision was issued as Department Instruction 80-1 on February 15, 1980.
Full compliance was achieved by this revision and no further action is determined to be necessary.
Enclosed is a check for $4,000.00 as required by the " Notice of Proposed Imposition of a Civil Penalty".
