Dear Mr. Restrick:
I reply to your letters of October 6,1971 an'd Nov-ember 4, 1971 (copy of letter to Myron M. Cherry) concern-ing the Babcock & Wilcox Co. proprietary reports regarding its emergency core cooling system.
It is the legal position of Mapleton Intervenors that you may not claim proprietary status for any reports re -
garding the emergency core cooling system in view of the critical importance of the reliability of such system to the public health and safety.
The public interest in a complete disclosure of all details concerning the ECCS outweighs the corporate proprietary interest.
It is vital that all reports regarding emergency core cooling systems be given the broadest possible distribution within the scientific and tachnical community to insure maximiim analytical input to the review of the performance capabil-it,f of the system.
It is our opinion that it is both illegal and imprac-tical to restrict such distribution in the manncr rc-quested by you.
i Accordingly, we demand that we be furnished with all ECCS reports forthwith.
