MaDRANDEM AND ORDER On Septsber 27, 1976, the U.S. Nuclear Regulatory Carmission Staff (the Staff) filed a motion requesting that the Board return the report of the Advisory Cceittee on Reactor Safeguards (ACRS) to the ACRS for clarification as required by the U.S. Court of Appeals for the District of Coltrabia Circuit in Aeschliman v. NRC, Appeal Nos. 73-1776 and 73-1867, decided July 21, 1976. Neither the Intervenors nor the Applicant oppose this motion by the Staff.
Accordingly, the Board hereby grants the Staff's motion and, by letter dated October 14, 1976, is returning the ACRS report to the ACRS for clarification. A copy of the Board's letter to the ACRS is attached hereto as Exhibit A.
