This is in response to your letter of May 18, 1971, to Robert O'Neill, Director, Office of Congressional Relations, in regard to the inter-l rogatories of the Saginaw Valley Nuclear Study Group that were served on the AEC regulatory staff in the Midland Plant construction permit proceeding. Your letter inquires in particular as to the status of the staff's reply to these interrogatories.
As you have noted, the interrogatories exceed 300 in number.
(The exact number is 336.)
In formal objections filed with the presiding Atomic Safety and Licensing Board, the staff requested that the inter-rogatories be disallowed on various grounds, including the undue burden l
that would be placed on the staff, and a failure on the part of the Saginaw Valley Nuclear Study Group to make an adequate showing of need for the information involved.
In oral and written presentations to the
[ ~~
i Board, the staff's position with respect to these interrogatories was 1
supported by the applicant, Consumers Power Company, and by the Dow Chemical Company, another intervenor in the proceeding.
[
t l
On June 1,1971, the presiding Atomic Safety and Licensing Board entered an order disallowing all but 21 of these interrogatories for l.
reasons set forth at length in the order itself, a copy of which is
}~
enclosed. Prior to the issuance of this order the Board had, by a series of three telegrams, directed the staff to answer the remaining The 21 interrogatories subject to certain specified limitations.
staff is now preparing answers in accordance with the Board's telegrams.
Sincerely,
