Boese of Representatives Bear Mr. Marveys his is in response to your letter of March 5,1971 conceraias a letter free Mr. Gerald C. Kruger of Freeland, Michigan, expressing opposition to the proposed muelaar power plant in Midland, Michigan.

The applicaties of Consumers Power Company for construction permits for the Midland Plant has been reviewed by the AEC regulatory staff and the i

Advisory Committee em Beacter safeguards (ACES). Both the staff and the ACES have semeluded that there is reaseeable assuranca that the proposed facilities seuld be seastructed and operated at the proposed site without undes risk to the health and safety of the public.

In seeerdance with previaf.ees of the Atomic Energy Act of 1954, as amended, the AEC initiated a public hearing which began in Midland on December 1, 1970. The hearing has been in recess simas that day pending the resolution of eertain preliminary matters. The presiding atomic safety and licensing beard presently plans to resmo the hearing en May 17, 1971.

Mr. Kruger,

and any other interested persee, is welcome to attend the hearing. We will motify Mr. Kruger of the time and place of the resimmed hearing when it basemos possible to de so.

We will also advise him of any change in schedule with respect to the date of the hearing.

Simee Mr. Kruger appears to be primeipally eencerned about releases of radiomative material from the proposed faealities, we mete for his infor-naties that Coasmers Fewer Company recently amended its application to provide for a new radiomative waste treatment system. This system is new under review by the regulatory staff and will undoubtedly be considered, as well, during the eeurse of the public hearing.

This is in reply to your letter of March 5, which transmits a referral from Mr. Gerald C. Kruger expressing opposition to the construction of tie proposed Midland Plant by Constners Power Company.

The application of Consumers Power Compan/y for a construction permit for Midland thits 16 2 was received by tle Atomic Energy Cocuission

, in January 1%9, and has been reviewed by the technical specialists in the AEC's regulatory staff and by the independent Advisory Connittee on Reactor Safeguards (ACRS). Both the regulatory staff and the ACRS have concitzled that there is reasonable assurance that tie facility could be constructed and operated at the proposed site without undue risk to the health and safety /of the public.

thder the pInvisions of the A'tomic Energy Act of 1954, as amended, a public hearing on all applications for construction permits for nuclear power plants is mandatory. Such hearings are conducted before a three-man atomic safety'and licensing board designated by the Commission, consisting of two members who are technically qualified and one member who is qualified in tle conduct of adninistrative proceedings. These hearings are held in the vicinity of the proposed site of the plant. The enclosed booklet, " Licensing of Power Reactors,"

provides further information 0; tM$ review process.

It is expected that the public hearing on Midland will be held on May 17, 1971, in Midland, Michigan, and I have asked the Public Procoedings Branch of the Consission to send a copy of the Notice of liearing to Mr 'Kruger when it is issued. The Notice will set forth l

the procedures by which a member of the public may participate in the hearing either as a party or by means of a limitad alwarance.
