Dear Senator Criffia:

This is in reopease to your March 17, 1971 transmittal of a letter from Mr. Gerald C. Kruger, Freeland, Michigan, opposing construction of the proposed Midland nuclear power plant.

The application of Consumers Power Company for construction permits for the Midland Plant has been reviewed by the AgC regulatory staff and the Advisory Committee sa Rametor Safeguards (ACRS). Both the staff and the AciS have concluded that there is reasonable assurance that the propesed facilities could be constreeted and operated at the proposed site without undue risk to the health and safety of the public.

In accordanes with provisions of the Atomic Energy Act of 1954, as ansaded, the AEC initiated a public hearing which began in Midland on December 1, 1970.

The hearing has been in recess since that day pending the resolution of certala preliminary matters. The presiding atomic safety and licensing board precently plans to resume the hearing on May 17, 1971.

Mr. Kruger, and any other interested person, is weleone to attend the hearing.

We will motify Mr. Kruger of the time and place of the restamed hearing when it becomes possible to do so.

We will also advise him of any change in schedule with respect to the date of the hearing.

Since Mr. Krugar appears to be principally concerned about releases of radioactive material from the proposed facilities, we note for his infor-nation that Consumers Power Company recently samaded its application to i

provide for a new radioactive waste treatment system. This system is now under review by the regulatory staff and will undoubtedly be considered, as well, during the course of the public hearing.
