Dear Mr. McGarry:

This is in response to your letter dated June 16, 1980, in which you requested, pursuant to the Freedom of Information Act (FOIA), records pertaining to five categories of information with regard to the proposed Fire Protection Rule.

No environmental impact statement was prepared, as noted in " Consent Calendar Item", SECY-80-88, dated February 13, 1980, Recommendation 3(c), p. 7.

This document has already been made available for public inspection and copying at the NRC Public Document Room (PDR),1717 H Street, N.W., Washington, DC 20555.

Each Fire Protection Safety Evaluation i

Report contained in each operating plant docket file in the PDR states that the upgrading of fire protection programs have an insignificant environmental impact.

a A document labeled " Enclosure B, Value/ Impact Assessment of Proposed Fire Protection Rule" in SECY-80-88, is available at the PDR.

A search is still undenvay for identification of records relating to item 3 of your request. To date, the staff has identified the handout and pmpared remarks by David Notley for the ACRS meeting on December 5, 1979, at'which meeting " Working Paper B", dated November 16,1979, was discussed. These documents are also available at the PDR. We will advise you as soon as the search for additional records is completed.

The staff further indicated that there are four years of studies, guidelines, research programs and plant evaluations, beginning with the

- study of the Brown's Ferry Fire as reported 'in NUREG-0050.

Copies of these documents are contained in the generic fire protection rule file and specific plant docket files in the PDR.

With regard to item 5, the staff has identified two documents:

(1) An April 2,1980, Routing and Transmittal Slip 'to George Sauter from Gus Lainas transmitting " Fire Protection Review Program Status", and (2) A May 1,1980, Memorandum for William J. Dircks from Samuel J. Chilk, on the Subject, " Staff Requirements--Affirmation Session 80-18, 1:35 p.m.,

Wednesday, April 23, 1980, Commissioners' Conference Room, D.C. Office (0 pen to Public Attendance)". These documents are available at the PDR.

Additional documents have been made available at the PDR with regard to another F0IA request for records pertaining to the proposed Fire Protection Rule. A copy of NRC's response to that request is enclosed.

You may obtain access to these documents by presenting a copy of this letter at the PDR or by requesting the documents mentioned above and folder FOIA-80-303.

The charge for reproducing records located in the PDR is eight cents ($0.08) per page, as specified in 10 C.F.R. 9.14(a).
