Since sending that letter, Censumers Power has had cause to change several of the co==itments in 'that " Quality Assurance Program" description as follows :

The need for an additional alternative to the implementation of Regulatory Guide 19h-April 1975 in that it has been found that the on-site batch plant is not in compliance with a requirement of Section h.3 of A:;3I 1145.2.5 This alternative is described in Attachment A to this letter. If this alternative is acceptable to the staff, it vill be included in 3ection I-K of the previously submitted " Quality Assurance Program" description as Iten lio. 2.

The existing ite=s IIos. 2, 3, 4 and 5 vill be renumbered to 3, h, 5 s.nd 6.

Bechtel expects to be in full compliance with their co==it=ents by May 15, 1977 with the following exceptions:

Procedures required to meet Regulatory Guide 1.30 have been implemented a.

except for two procedures in the area of installation of electrical equipment. Full compliance in this area is expected before July 1,1977 b.

Procedures required to meet Regulatory Guide 1.3T have been implemented except for one procedure in the area of cleaning of fluid system compo-nents.

Full compliance in this area is expected before July 1,1977 Additional procedures which may be required for ccmpliance to this Regulatory Guide vill be developed prior to scheduled work in this area.

Procedures required to meet Regulatory Guide 1.9h have been implemented except for seven procedures in the inspection area for structural con-crete and structural steel. Full compliance in this area is expected by July 1, 1977 It is proposed to revise Section II B of the " Quality Assurance Program" descrip-tion to be as shown in Attachment B.

Also in response to questions from the staff,Section II C of the " Quality Assurance Program" description vill be revised as shown in Attachment B.

The above change in Bechtel commitment dates and Babcock & Wilcox effectivity data

( Attachment B) reflects the telephone discussions between Messrs J J Zabritski (CP Co) and Ray Powell (URC-DPM) on May 13, 1977 Please review the proposed attachments for inclusion as revisions to the " Quality Assurance Program" description submitted by our March 23, 1977 letter.

Upon receipt of HRC approval of our revised " Quality Assurance Program" descrip-tion and the Revision 3 to the B&W QA Topical Report, we vill initiate efforts to include the " Quality Assurance Program" description as a revision to Appendix 1B of the Midland PSAR.

2) Section 4.3 Measuring, Mixing and Transporting Equipment requires measuring and mixing of concrete to be in accordance with national Ready Mix Concrete Association, - (URMCA), Concrete Plant Standard and Truck Mixer and Agitator standard.

The URMCA Plant Standard Section 2.2 requires that the batching recorders,

".... shall register both empty balance and total weight of each batched material."

The concrete batch plant at the Midland site vill not provide a zero print-out on our batch plant ticket. Since our control panel locks out until the scale reads zero, the system meets the intent of NRMCA even though the printer does not provide a numerical indicator.

EFFECTIVITY DATES Gubject to the exceptions contained in Section III below, the preceding commitments will be implemented on the folleving dates for all subsequent safety-related activities relative to the Midland Project:

A...For Consumers Power Activities; December 2,1976 B.

For Bechtel Activities; May 15, 1977 with the exception of commitments relative to Regulatory Guides 1.30, 1.37, 1.38, 1.39 and 1 9h where the effectivity date vill be July 1,1977 C.

For Babcock and Wilcox Activities; within 30 days of B&W receipt of NRC approval for Revision 3 to their QA Topical Report.
