Dear Dr. Morris:
In order that the construction of the Midland Nuclear Power Plant, Units 1 and 2, may continue on schedule, such that Unit 1 vill be available for com:lercial operation in the vinter of 1974, and inas-much as delays at this time vill significantly affect the ability of our system to meet the public need for power generation, we hereby re-quest, pursuant to Code of Federal Regulation Title 10, Section 50.12,
" Specific Exceptions," en exemption from the requirements of the pro-visions of Code of Federal Regulations Title 10 Section 50.10(b), in order to allow certain construction as described below to begin prior to issuance of a construction permit. Issuance of the exemption vill not endanger life or property or the common defense and security, and will be in the public interest.
In addition to site excavation, backfill and reccupaction, if necessary, installation of mud slabs, waterproof membrane and working mat, placing of forms and placing and splicing of reinforcing bars for the nuclear structures, and constniction work on non-nuclear facilities including the turbine building and turbine generator foundations, all of which are permitted under Title 10, Section So.10(b), permission is requested to proceed with installation of portions of the Auxiliary Building and Units No. 1 and 2 Reactor Buildings that are belov finished grade described as follows:
1.
Placing of concrete for the substructure of the auxiliary building.
2.
Placing of concrete for the tendon galleries for the Units No. 1 and 2 reactor buildings.
3 Placing of concrete for the foundations for the
. Units No. 1 and 2 reactor buildings.

Details of the work are provided on the attached Drawing 7220-SK-C-243, Rev. C.
Included in tha concrete work would be the neces-sary piping, grounding, conduit, floor drains, and other embedded items.
The quality Assurance Program outlined in the PSAR vill be in effect during the perfomance of the above work.
Consumers Power Company requests that this exemption be issued no later than July 15, 1970 so that construction can proceed in accor-dance with a schedule that will pemit commercial operation of Unit No.1 by the vinter of 1974. Although the Company does not expect Unit No. 2 to supply power until 1975, sound engineering and construction practices require that the work requested be perfomed concurrently for both units.
Consumers Pover's construction schedules anticipated receipt of construction permits by March 1, 1970. It is now unlikely that the regulatory proceeding vill be concluded and construction permits issued so as to permit commercial operation of Unit No.1 by the vinter of 1974.
If commencement of constmetion were to be
- las/ed until the construction pemits are issued, the lost time vould seriously affect the proper sched-uling of construction work and thus impair Consumers Power's ability to meet its projected service date for Unit No. 1.
Particularly, such a de-lay vill move much of the preliminary concrete work into the vinter season when unfavorable weathr.r conditions vill make it virtually impossible to meet consnercial service dates. Failure to receive this exemption by July 15, 1970 and the resulting delay in co'aneneing construction vill result in a delay in the r%pletion of the plant by about six months.
It is important that Midland Unit No.1 be completed and avail-able fcr co e rcial operation by the vinter of 1974. The estimated 1974 vinter peak-hour load of the Company is 5175 MW while, without Midland Unit No.1, the installed generating capacity of the Company vill be only 5081 MW.
If Midland Unit No.1 is unavailable for service during the vine ter of 1974, Consumers Power's reserve vill be a negative 1.8v if no short-p tem capacity is available for purchase from outside sources. It presently appears that if Midland Unit No. 1 is not available in the vinter of 1974, the Michigen Electric Power Pool, consisting of Consumers Power and The Detroit Edisen Company as principal partners, vill have a reserve of 224.
This 22%, however, can only be obtained by continuing in service several units scheduled for retirement in 1972 and 1973 Assuming that the Company is able to purchase short-tem capacity through the Michigan Electric Fover Pool, additional costs to the Company will approximate $1,600,000 in capacity and energy charges for every month the unit is delayed. Also, if the vari-ance is not received by July 15, 1970 and therefore the requested work can-not be perfomed in 1970, construction costs of the project vill increase by $13',000,000.
