Dear Miss Evans:

This refers to your letters dated September 21, 1970 and October 28, 1970 to the Director of Regulation and nyself, regarding your concerns on the need for increased electricity generating capacity in nortnwestern Ohio as a justification for an execption granted to The Toledo Edison Company and The Cleveland Electric Illuminating Company (the applicants) to allow certain pre-construction permit work to be conducted at the Davis-Besse site. We had delayed answering your letter of September 21, 1970, pending receipt of coments from the Federal Power Commission (FPC) which we believed would provide the necessary infornation concerning generating capacity, reserves and load predictions in your area. This information has been received by letter dated Noven.ber 3,1970, from the FPC and a copy is enclosed for your information.

The applicants requested an exemption by letter dated June 4,1970, to permit construction of certain portions of the Davis-Besse Nuclear Power Station prior to issuance of a construction permit by the AEC to ncet a scheduled plant operational date of December 1974. To support th e justification for an exemption request, the applicants submitted the enclosed letter dated August 12, 1970, providing additional information to-support the basis for establishment of the public need for the Davis-Besse plant generating capacity to meet the predicted required electricity load for December 1074.

The Regulatory Staff discussed with the Federal Power Comission the exemption request, and the Federal Power Cornission indicated that there is -a public need for the Davis-Besse generating capacity to be operational by December 1974. After completion of our review of the exemption request, the exemption was granted on September 10, 1970, to allow construction of.

certain foundations, walls, and floors of the shield building and auxiliary building up to elevation 583 feet, 6 inches (ground level).

I am enclosing a copy of a letter, dated October 14, 1970, from the State of Ohio Department of Health which contain cornents on the public need for the Davis-Besse Nuclear Power Station generating capacity.
