Dear Mr. Price:

In order that construction of the Davis-Besse Nuclear Power Station may proceed on schedule, we hereby request, pursuant to Section 50.12 of 10 CFR Part 50, an exemption from the provisions of Section 50.10(b) to allow certain work prior to the innuance of a construction permit.

In addition to nite excavation, installation of mud alabo, waterproof membranes, and working mats, placing forms, placing and splicing of reinforcing bara for the nuclear structures and construction work on non-nuclear facilities, all of which are permitted under Section 50.10(b),

we vinh to proceed with the pouring of the concrete for the shield building ring foundation, the shield building walla up to elevation 583'-6", the foundation mats for the auxiliary building, walla and floors up to elevation 58?'-6" and the necessary backfill. All of the work will be below finished grade level of 584 feet. Ir.cluded in the concrete work would be the necessary piping, grounding, conduits, floor drains and other embedded items. The attached drawing sheeta 1, 2, 3, h and 5 show the extent of the work to be accomplished.

The Quality Assurance Program outlined in Appendix 1B of the PSAR will be in effect during the performance of the above work.

It is important that the Davis-Besse Nuclear Power Station be available for commercial operation by December 1,1974 and to provide for an orderly construction schedule to achieve this date, the lower portions of the chield building and auxiliary building must be constructed in the fall and early winter of this year.

The Davis-Besse Nuclear Power Station is a pooled unit of the CAPCO Group and the reliability of customer service within the CAPC0 Group is '

dependent on timely and coordinated addition of such units.

Toledo Edison's forecast December peak hour load in 1974 is 1,292 is while the net system capability will be 1,585 I& including its initial 278 IG share of the Davis _Besse unit. Without this unit, Toledo Edison would be dependent on other CAPC0 Group capability for practically its j entire reserve and both Cleveland and Ohio Edison vould have their system capability reduced by 414 JG and 180 IG respectively. This would reduce the CAPCO Group reserves below that considered acceptible to assure reliable service to the customers.

It is requested that this exemption be issued no later than August 15, 1970 so that construction can proceed in accordance with a schedule that will permit commercial operation of the Davis-Besse Nuclear Power Station by December 1,197h.
