Dear Mr. Case:
Your letter of June'28, 1978 to Mr.
R. A. Miller, Executive Vice President.of The Cleveland Electric Illuminating Company ("CEI"';,
has been referred to me for reply.
Attached thereto as Appendix A was a Notice of Violation issued pursuant to Section 2.2^'.(a) of
. the Commission's Rules of Practice, 10 C,F.R. S 2.201(a).
In answer to that Notice of Violation, CEI states as follows:
- 1. - CEI denies that it has not complied with antitrust license condition No. 3 or any other antitrust license condition attached to the Davis-Besse Unit 1 operating license and the Perry Units 1 and 2 construction permits, and further affirmatively states that it is in full compliance with all of said conditions.

CEI specifically denies the five enumerated objec-tions set forth by the-Staff in said Notice of Violation, and further 3
' denies that those objections, whether considered individually or in concert, constiture unreasonable conditions tantamount to a refusal to wheel'in violation of antitrust license condition No. 3.

Case July 14, 1978 Page Two incorporates them herein by reference as if set out in full (a copy of said letter is attache 3 hereto as Exhibit A).

CEI further states that on June 14, 1978, the Federal Energy Regulatory Commission ("FERC") issued an Order with respect to CEI's proposed Transmission Service Tariff filed on January 27, 1978.
The FERC Order accepted for filing the CEI Trans-mission Service Tariff, effective as of February 27, 1978 as re-quested by CEI, and suspended for one day until February 28, 1978 the rates contained therein; following the one-day suspension, said rates became effective subject to refund.
That Order also permitted the City of Cleveland to intervene in the FERC proceeding to be held in connection with CEI's Transmission Service Tariff.
For all the foregoing reasons, CEI believes the Notice of Violation to have been improvidently issued and requests that, fol-lowing a further review of the matter, the Office of Nuclear Reactor Regulation issue a notice withdrawing its June 28, 1978 Notice of Violation.
If the Notice of Violation is not withdrawn, CEI pres-ently anticipates requesting at the appropriate time that the matter be set for hearing in accordance with Section 2.202(b) of the Com-mission's Rules of Practice, 10 C.F.R. S 2.202(b).
Representatives of CEI would, of course, be willing to meet with you at your earliest convenience to discuss NRC's recommended changes to the referenced transmission shcedule, as set forth in Appendix B to your letter, in an effort to resolve the apparent dif-ferences regarding appropriate language.
