9 Federal Register Notice ADVISORY CO:04ITIEE ON REACIOR SAFEGUARDS NUCLEAR REGUIA'lVRY COIC4ISSION Notice of Meeting In accordance with the purposes of Sections 29 and 182b. of the Atomic Energy Act (42 U.S.C. 2039, 2232 b.), the Advisory Comittee on Reactor Safeguards will hold a meeting on January 6-8, 1977, in Room 1046, 1717 H Street, NW, Washington, DC.

The agenda for the subject meeting will be as follows:

Thursday, January 6, 1977 8:30 A.M. - 9:00_A.M.:

Executive Session (Ocen) - The Comittee will discuss the status of its activities with respect to several generic matters including safeguards provisions related to nuclear facilities; environmental effects of the light water reactor fuel cycle; and re-view of proposed NRC siting policy. The Comittee will discuss the disciplines required to conduct an ACBS review.

9:00 A.M. - 9:15 A.M. : Executive Session (Closed) - The Comittee will meet in closed executive session to exchange and discuss the per-sonal opinions of individual members leading to the formulation of advice and recomendations regarding selection of candidates for appointment to the ACRS and the classification of safeguards infor-mation related to nuclear facilities.

Executive Sesion (Ocen) - The Comittee will hear and discuss the report of the ACRS Subcomittee and consultants who may be present regarding the request for an Operating License for the I

Davis Besse Nuclear Power Station (Coen)

The Comittee will hear presentations of the NRC Staff and the Applicant related to the request for an Operating License for this Station. Portions of this session will be closed if required to discuss Proprietary Information related to this Station and to discuss safeguards provisions for this plant.

1:30 P.M. - 2:30 P.M.:

ACRS Meeting with NRC Comissioners (Ocen/ Closed) - The Comittee will meet with the Comissioners in open session to discuss the status of ACRS activities with respe:t to several generic matters including safeguards pro-visions for nuclear facilities, the environmental effects of the LWR fuel cycle and review of NRC siting policy.

The Comittee will meet with the Comissioners in closed session to discuss the classification of safeguards information related to nuclear facilities and the basis for selection of ACRS members.

- 2:30 P.M. - 3:00 P.M.:

Ey2cutive Session (Ocen) - The Comittee will hear and discuss the report of the ACRS Subcomittee and con-sultants who may be present regarding the request for an Operating License for the North Anna Power Station Units 1 and 2.

Portions of this session will be closed if required to discuss Proprietary Information related to this plant and safeguards provisions for this Station.

3:00 P.M. - 7:15 P.M.:

North Anna Power Station Units 1 and 2 -

The Comittee will hear presentations by and hold discussions with representatives of the NRC Staff and the Applicant related to the request for an Operating License for this Station. Portions of this session will ba closed if required to discuss Proprietary Tnfor-mation related to this plant and safeguards provisions for this Station.

Friday, January 7, 1977 8:30 A.M. - 9:30 A.M.:

Executive Session (Open) - The Comittee will hear and discuss the report of the ACRS Subcomittee on Regulatory Activities. This will include discussion of proposed Regulatory Guides and regulatory activities such as evaluation of steam gen-erator tube integrity for pressurized water reactors; radiation surveillance programs in Babcock and Wilcox Company pressurized water reactors, and proposed review of the seismic design basis for the San Onofre Nuclear Generating Station Unit 1 and the Humboldt Bay Nuclear Plant Unit 3.

- 9:30 A.M. - 12:00 Noon: Meeting with Representatives of the NRC Staff (Open) - The Comittee will meet with representatives of the NRC Staff to hear presentations and to discuss matters related to resolution of selected safety issues related to light water reac-tors, the NRC-ACRS decisionmaking process, recent reactor operat-ing experience and licensing actions, and the future schedule for ACRS activities. Merbers of the Staff will report to the ACRS re-garding safety research in the Federal Republic of Germany related to reactor containment.

1:00 P.M. - 1:45 P.M.:

Executive Session (Open) - The Comittee will hear and discuss the reports of its Subcomittees and con-sultants who may be present regarding the request for approval of Exxon NU lear Company reload fuel for pressurized water reactors and for operation of the Donald C. Cook Nuclear Plant Unit 1 with Exxon Nuclear Company reload fuel. Portions of this session will be closed if required to discuss Proprietary Information regarding these matters and safeguards provisions related to the Donald C.

Cook Nuclear Plant.

1:45 P.M. - 3:00 P.M.:

Exxon, Nuclear Company Reload Fuel for Pressurized Water Reactors (Ocen) - The Comittee will hear prer mtations by and hold discussions with representatives of the NRC Staff and the Exxon Nuclear Company regarding proposed

. reload fuel for use in pressurized water reactors. Portiens of this session will be closed if required to review Proprietary Information related to the design, fabrication or operation of this type fuel.

3:00 P.M. - 5:30 P.M.:

Donald C. Cook Nuclear Plant Unit 1 (Ocen)

The Comittee will hear presentations by and hold discussions with representatives of the NRC Staff and the Applicant regarding the operation of the Donald C. Cook Nuclear Plant at full power with reload fuel provided by the Exxon Nuclear Company. Portions of this session will be closed if necessary to discuss Proprietary Information related to this plant and safeguards provisions for thi aon.

5:30 P.M. - 6:30 P.M.:

Executive Session (Closed) - This portion of the meeting will be closed to discuss prospective candidates i

for appointment to the Comittee.

Saturday, January 8, 1977 8:30 A.M. - 4:00 P.M.:

Executive Session (Closed) - The Committee will meet in closed executive session to exchange and discuss perscnal opinions and recommendations leading to the formulation of advice with respect to items considered at this meeting. Pro-posed ACRS activities and reports on generic matters such as l

the environmental effects of the LWR fuel cycle and selected safety issues related to LWR reactors will be discussed.

and discussion of information which, if written, would fall within the provisions of exemption 5 of 5 U.S.C. 552(b) (5 U.S.C. 552(b) (5)), to preserve the confidentiality of procedures for the protection of infor-mation related to safeguarding of special nuclear material and the basis for appoint: rant of ACRS members which is intra-egency and 4 perscnnel f

7-Practical considerations may dictate alterations in the above agenda I

or schedule. The Chairman of the Comittee is empcreered to conduct the meeting in a manner that in his judgment will facilitate the orderly con-duct of business, including provisions to carry over an incompleted open session from one day to the next.

The Advisory Comittee on Reactor Safeguards is an independent group established by Congress to review and report on each application for a construction permit and on each application for an operating license fct a reactor facility and on certain other nuclear safety matters. The Comittee's reports become a part of the public record. Although ACRS meetings are ordinarily open to the public and provide for oral or written statements to be considered as a part of the Comittee's in-formation gathering procedure concerning the health and safety of the public, they are not adjudicatory type hearings such as are conducted by the Nuclear Regulatory Comission's Atomic Safety & Licensing Board as part of the Comission's licensing process. ACRS meetings do not normally treat matters pertaining to environmental impacts outside the safety area.

With respect to public participation in the open portion of the meeting, the following requirements shall apply:

(b) Those persons wishing to make oral statements regarding agenda items at the meeting should make a request to do so prior to the meeting, identifying the topics and desired presentation time so that appropriate arrangements can be made. The Comittee will receive oral statements in safety related areas within the Comittee's purview at an appro-priate time chosen by the Chairman of the Comittee.

(c) Further information regarding topics to be discussed, whether the meeting or portions of the meeting have been cancelled or rescheduled, the Chairman's ruling on requests for the oppor-j tunity to present oral statements, and the time allotted therefor, can be obtained by a prepaid telephone call on January 5,1977, to the Office of the Executive Director of the Comittee (Telephone: 202-634-1371) between 8:15 A.M. ard 5:00 P.M., Eastern Time.
