The Toledo Edison Cc many (TEco) and T'ic Cleveland ::lectric Illuminatin; Co::r any (CCICo), recuested an additional exenption, pursuant to 17 CF' 53.12 frem the provisions of 10 CFR 50.11(b) to permit additional construction verk on the Davis-Jesse Nuclear Power Station.
An exemption was granted to the applicants on Senter.ber 10, 1970, to permit the following construction to be acconaliahed prior to issuance of a construction permit:
1.
Occcrete and reinforcin:- steel placerent for construction of the rin; foundation and valls of the shield buildia; u' to trade icvel (333 feet 6 inches elevation),
2.
Concrete and reinforcin; steel placerent for construction of mato,
'talls, and floor slabs of the auxiliary building un to nrade level (333 feet 6 inches elevation),
3.
Installation of water 9:oof menbranes, all c=hedded ciping, nroundin.:
cenduits, floor drains, and backfill up to grade level (333 feet 6 inches elevation) for the shield and auxiliar* buildin;* cons truc-tion described in (1) and (2) above.
.The application for the construction permit is presenti? the subject of a contested hearinn. Two groups and one individual have been adnitted as intervenors in this proceeding opposed to the issuance of the construction permit. These are: a) Coalition for Safe Nuclear Power b) Living in a Finer Environment and c) lir. Glenn L. Lau.
During the first session of the public hearinn, December 8 to 10,1970, the board granted the intervenors until January 5, 1971, to complete the preparatien of their cases. During the second session of the hearing, January 3 to 7, 1971, the board granted intervenors until January 25, 1971, to cooplete preparation of their cases.

4 Connaissioners Because of the uncertainty as to shen a construction pernit will be issued for the Davis-Besse Nuclear Power Station, on January 7,1971 The Toledo Edison Company requested an additional excuation to include the following additional construction below finished grade level (i.e.,
below elevation 583 feet 6 inchen):
1.
Installation of the containment vessel inside the walls of the shield building up to grade level, 2.
Placement of the concrete fill inside and outside the containc.ent vessel bottom head and installation of embodrents within the inside fill concrete, 3.
Place ent of all concrete structures sithin the containrent vessel up to grada level.
On January 15, 1971, ve received telegrams frem the intervenor, Livin; In A Finer Environ.ent (L.I.F.C.), and the Coalition for Safe Muclear 'over protesting the additional exerntion.
In a letter dated January 12, 1971, counsel for intervenor L.I.F.E. also objected te the Tranting of the reques ted exemption.
