Dear Mr. Boyd:

Enclosed please find a request for an Operating L. cense amendment and its associated safety evaluation to change the Davis-Berse Nuclear Power Station Unit 1 Technical Specifications. The change to the Table 3.2-1 "DNB Margin" Reactor Coolant Flow Rates is being requested to accommodate the DNBR penalty as delineated in the Davis-Besse Unit 1 Operating License NPF-3, condition 2C.3.(1), Rod Bow Penalty.

Toledo Edison considers this request for any Operating License Amendment to be exempt from the License Fees under provisions of Footnote 2 under the " SCHEDULE OF AMENDMENT FEES FOR REACTOR FACILITY PERMITS, LICENSES, AND OTHER APPROVALS REQUIRED BY THE LICENSE OR COMMISSION REGULATIONS" given in Section 170.22, P. 7220 of Federal Register dated February 21, 1978.

This technical specification change is being requested on an emergency basis since the one hundred (100) effective full power days specified in licensed condition 2C.3.(1) is expected to occur on May 16, 1978.

Further, this emergency request results from your lack of attention to our October 4,1977 letter (Serial Number 388) which requested your early review of the B&W rod bow model. We had also previously urged your review of this model prior to the issuance of our Operating License.

. The attached Table 3.2-1 has been modified to show higher reactor coolant flow rates which the system can provide with margin and which will accom-modate the DNBR penalty associated with Rod Bow as required by operating license condition 2C.3.(i). ,
