Toledo Edison acknowledges receipt of your August 10, 1978 letter and report enclosure 78-18, referencing apparent deviations from Davis-Besse Nuclear Power Station, Unit No. 1, commitments to the NRC listed

as an " Infraction" under the heading " Notice of Violation."
v Following a thorough examination of the item of concern, Toledo Edison herein offers information regarding the item of non-compliance.
Infraction: Contrary to 10 CFR 50.59(b), reactor operation with monitor RE 1003 (condenser vacuum pump discharge) inoperable since mid-year 1977 was not evaluated to determine whether the change from the FSAR described operation involved an unreviewed safety question.
Response
An evaluation to determine if an unreviewed safety question was involved will be completed by September 10, 1978.
Revision 13 to AD 1805, Procedure Preparation and Maintenance, approved July 25, 1978, has provided a mechanism for a 10 CFR 50.59 review of changes to station operating procedures.
