PHONE INQUIRY ON DUKE POWER COMPANY'S OCONEE UNIT I, DOCKET No. 50-2_6_9, On January 18, 1971, Mr. Charles H. Keplin, Environmental Protection Jgency, FWQA, Atlanta Office, called me in regard to Duke's environmental statement.- He posed three questions:

How did Duke respond to the September 28, 1970 Department of Interior

letter on the Duke environmental statement?
i On Question No. 1 I stated that Duke has responded on the record to all agency comments. Their revised environmental statement as such was not subtritted.
I Da Question No. 3 I discussed the October 30, 1970 Duke letter which covered all points raised by the Interior letter of September 28, 1970.
On Question No. 2 I indicated that to date there has been no request for a hearing, but that since the notice of intent to issue an operating
. license was published January 8,1971, we won't know until February 8
.if such a request will be made.
In closing, Mr. Kaplin said he was looking into the possibility that Duke may have to have a Corps of. Engineers water discharge permit for Oconee.
He specifically mentioned Executive.Crder 11574 as making such permits mandatory for all industrial discharges to navigable waters. He also k
inquircd as to whether'AEC would allow intervention on thermal water quality grounds.
I was unable to advise him on this matter.
