5 This refers to the investigation conducted by the NRC Office of Investigationt (OI) on September 5, 1986, through May 13, 1988 of activities at the Clinton Power Station. The Investigation Report No. 3-86-008 was sent to you on i

february 14, 1989.

On June 14, 198S, an Enforcement Conference was conducted at the Region III

o Office at which time you presented your findings and conclusions with regard to the OI Report. At the conclusion of the Enforcement Conference, Illinois

Power (IP) was asked to provide additional information concerning certain aspects of the IP presentation.

You provided that information by letter dated, June'27, 1989.

As a result of our evaluation of the NRC investigation findings, your

presentation and the additional information you provided on June 27, 1989.-the t

following conclusions have been reached:

1.

Although there were some conflicts between interviewee statements to the 01 and IP investigators: (1) there was testimony that the Engineer provided i

' instruction to subordinates to employ uncalibrated Measurement and Test l

Equipment (ll&TE) to obtain qualitative measurements; (2) the Engineer's t

i instructions were consistent with site practice, but they violated the rt. lated site procedures because the use of uncalibrated 16 E to obtain qualitative measurements was not allowed; and (3) thert was no actual l

L violation of site procedures because subordinates did not execute the j

Engineer's instructions.

An apparent program weakness existed because site training and practice allowed the use of.uncalibrated M&TE to obtain qualitative measurements which conflicted with certain site procedures (GTP 124. Revision 0, dated t

May 21, 1985 and GTP 131, Revision 0, dated August 30,1985).

The Engineer is no longer employed by IP.

We reccanize that at least one of the subordinates did not take the instructions seriously. Nevertheless, we consider m y instructions contrary to procedures to be significant.
