I I am responding to your letter of July 31, 1989 to Senator Mikulski, which she I

sent to the U.S. Nuclear Regulatory Comission (NRC) for consideration.

i One of the statutory missions of the NRC is to ensure that comercial nuclear power plants are operated in such a manner that the health and safety of the public are adequately protected. While pursuing this mission, the NRC became j

concerned about the declining performance of Calvert Cliffs.. However, let me assure you that at no time did this decline in performance present any hazard which threatened the adequate protection of the health or safety of the public.

1 As a result of this declining. performance, the NRC classified Calvert Cliffs as a facility having weaknesses that warranted increased attention. This classifi-cation resulted in the Baltimore Gas and Electric Company's (BGAE's) submission of a preliminary Performance Improvement Plan to the NRC on April 17, 1989, which was developed to identify the root causes of the facility's declining performance and to specify the actions that would be taken to improve its performance.

In addition, BG&E submitted a deteiled implementation >rogram for this plan on July 31, 1989, which provided an in-depth analysis of tie actions and resources required to achieve improved plant performance. Finally, the NRC established a panel: consisting of. senior NRC personnel to evaluate BG&E's performance improvement efforts as outlined in the plan.

Until the Performance Improvement Plan is fully implemented. BGAE has agreed to take corrective actions for equipment problems and for the weaknesses identified in (1) the control of system status. (2) the control of work activities, and (3) procedural control and compliance at Calvert Cliffs before restarting either unit. On May 25, 1989, the NRC issued a Confirmatory Action Letter reiteratingtheplantdeficienciestobecorrectedandindicating<oreeither to BG&E that i

Since Calvert Cliffs was classified as warranting increased attention, the NRC has increased its overall inspection coverage at the facility. This level of inspection activity will continue and will include verification of the adequacy of BGAE's actions to correct identified weaknesses before either plant is I

restarted.
