I We note that the applicable portion of Section 105(c) of the Atomic Energy l Act provides:

"(2) Paragraph (1) of this subsection shall apply to an I application for a license to construct or operate a I utilization or production facility under section 2133 of this title: Provided, however, That paragraph (1) j shall not apply to an application for a license to oper- i ate a utilization or production facility for which a i construction permit was issued under section 2133 of I this title unless the Comission determines such reviev l is advisable on the ground that significant changes in I the licensee's activities or proposed activities have l occurred subsequent to the previous review by the Attor-ney General and the Commission under this subsection in connection with the construction permit for the facility."

(Emphasis added.)

As you are probably aware, NRC Appeal Board's decision of December 30, 1977 (ALAB-452, Docket Hos. 50-329A and 50-330A) remanded the ongoing construction permit antitrust review proceeding on the Midland Units for supplementing the record and making appropriate findings as to license conditions. Thus, it is evident that the " previous review by the Comission" has not yet been completed. l l

, . ., . 2 We anticipate that much of the informstion called for by Regulatory Guide 9.3 would be submitted as evidence in the remand proceeding ordered by the Appeal Board. It would cause a significant duplication of effort on the part of both the NRC and Consumers Power Company to proceed in accordance with Regulatory Guide 9 3 while the construction permit antitrust review is still in the process of being completed.
