This is in reply to your request dated May 28, 1970, for an exemption, pursuant to Section 50.12, from the provisions of Section 50.10(b) which would permit the performance of certain work se the site of the Midland Nuclear Power Plant prior to the issuance of a construction permit by the Commission.

1 You stated that the requested work would permit construction to pro-coed on a schedule that would make the plant available for conumercial operation by the winter of 1974 and maintain that delays at this time would significantly affect the ability of your system to meet the i

public need for power generation. The requested work cons!.sts of:

(1) placing of concrete for the substructure of the auxiliary building up to Elevation 614, (2) placing of concrete for the tendon galleries for the Unita 1 and 2 rasctor buillings, and (3) placing of concrete for the foundations for the Units 1 and 2 reactor buildings. This work includes the placing of embedded items in the foundation slah and walls including reinforcing steel, cadwald connectors, sump liner plates, thickened floor liner plato, liner plate veld backing strips, anchor bolts, door frames, beam brackets, waterstops, pipe sleeves, reactor building mat columns, the tower crane nast section for the temporary crane, and auxiliary building pipe tunnels.

You also stated that reinforcing steel embedded in the reactor building foundation slab will extend into srsas to be occupied by the building walls at a later date.

Consumers Power Company Ve have reviewed your request for an exemption under the provisions of Section 50.12 and the reasons set forth in support thereof, and have concluded that the ?, ranting.of the exemption is authori::ed by law, will not endanger life or property or the co= ton dufense and security and is otherwise in the public interest. Accordin:;1y, the Commission hereby authorizee you, at this time, to proceed with the placement of the concrete to form the substructure of the auxil-iary building, the tendon galleries for Units 1 and 2 reactor buildings, and the foundations for Units 1 and 2 reactor buildings, including other embedded items as described in your letters of :tay 28, 1970, and June 24, 1970.

I wish to emphasize that the granting of this exemption shall hava no bearing upon the subsequent granting or denial of a construction petuit or of any further exemption for the proposed Midland Nuclear Power Plant, and any work performed pursuant to this exemption snall be performed entirely at the risk of Consumers Power Company.

Furthermore, the granting of this exe:aption does not constituto an approval of the type or adequacy of the method of installation.
