Sections 9.2.2.2 and 9 2.2.h of the Midland PSAR state in part:

This system pern- t3 chemical addition to the reactor coolant system, the reactor auxiliary systems, and the radioactive vaste treatment system during normal operation and nas no active emergency func tion. . . . . .

The system is not required to function during an emergency, nor is it required to take action to prevent an emergency .

condition. It is therefore designed to perform in accordance with standard practice of the chemical process industry with duplicate equipment.

The philosophy which allows the chemical addition system to be quality group D, non-seismic class 1 is that the water and boric acid in the quality group B, seismic class 1 EWSTs is available and sufficient to place and maintain the reactor in a cold shutdown condition. This capacity exists for either a feed and bleed or a feed without bleed cooldown.

Since our position' may be construed as contrary to the 6uidelines of Regu-latory Guides 1.26 and 1.29, and since it is imperative that we finalize the design requirements and procure components , especially the boric acid addition tanks, in the ver/- near future in order to maintain our construc-tion schedule, ve request that you review our intentions in this area and provide your evaluation as soon as possible. Should you consider a meeting with your staff necessary ve request that this meeting be scheduled as soon as possible.
