N_0TICE OF VIOLATION 3

Wisconsin Electric Docket Nos. 50-266; 50-301 i

Power Company Licenses No. DPR-24; DPR-27 As a result of the inspection conducted between March 1 through May 12,

')

1989, and the Enforcement Conference held on June 2,1989, and in accordance with the " General Policy'and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the following violations were identified:

1.

Technical Specification 15.4.6.B.4 states, "Ea:h battery shall be subject to a load test at intervals recommended by the manufacturer but not exceeding five years." By letter dated July 6, 1988, under subtitle " Recommendations" on page 6, the manufacturer stated, in part, "you have indicated that the next scheduled outage will be in October 1988 for' Unit 2 (battery B).

At this time, the battery should be capacity tested as mentioned earlier in this evaluation."

Contrary to the above, the licensee did not conduct a load test on i

battery B until requested to do so by the NRC in May, 1989.

This is a Severity Level IV violation (Supplement 1).

Technical. Specification 15.6.8.1 states, in part, "the plant shall be operated and maintained in accordance with approved procedures."

Maintenance Work Request (MWR) Procedure PBNP 3.1.3 requires the assignment of a qualified QC inspector to review the work if the work is QA scope, i

A qualified QC inspector did not review the replacement of wood in the battery racks that was performed under MWR 870261 in August 1987, when the MWR designated this work as QA scope.

A qualified QC inspector did not review the replacement of molded j

case circuit breakers in safety-related panels that was performed under MWR 884006 in November 1988, when the MWR designated this work as QA scope.

This is a a Severity Level IV violation (Supplement 1).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:

(1) the corrective actions 1

that have been taken and the results achieved; (2) the corrective actions that will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
